LEGAL NOTICE

1. GENERAL PROVISIONS

Within the scope of the activity of the Portuguese company MARSOG, LDA., the online store coisasdeviana.pt was created, where the user can purchase regional and contemporary craftsmanship from Viana do Castelo and the Minho region (Portugal), whose description and detailed information can be found by clicking on the item of interest.

MARSOG, LDA is the holder of the registered trademark MARSOG ®.

1.1 - These General Terms and Conditions of Sale (hereinafter "General Conditions") exclusively regulate the contractual relations established between all users of the website coisasdeviana.pt (hereinafter "User") and MARSOG, LDA., a limited liability company, with a share capital of 10,000.00 Euros, with registered office at Rua da Bela Vista, n.º 5 - Santa Marta de Portuzelo, 4925-029 Viana do Castelo, Portugal, registered at the CRC of Viana do Castelo with Main CAE 13991, NIPC No. 508 502 721, (hereinafter “MARSOG, LDA.”) and replace any other contractual conditions, unless the Parties have agreed otherwise in writing, previously and expressly.

MARSOG, LDA. may occasionally modify certain provisions of its General Conditions, so the User should read the General Conditions carefully upon each visit to the website coisasdeviana.pt (hereinafter "Site").

The User should not validate any order made on the Site if they do not consider themselves duly informed and clarified regarding the content and scope of the General Conditions.

By using the Site, the User undertakes to respect these General Conditions, which were drafted in compliance with Decree-Law No. 24/2014, of February 14, Decree-Law No. 7/2004 of January 7, and Law No. 24/96 of July 31.

1.2 - MARSOG, LDA. is responsible for managing the Site coisasdeviana.pt and for selling the items presented therein, which are described as rigorously and detailed as possible.

1.3 - When placing an order on coisasdeviana.pt, the User:

• Declares to have read and agreed to these General Conditions, without the need for any subsequent act or consent;
• Declares to be at least eighteen (18) years of age and/or of legal age in their jurisdiction of residence;
• Declares to have the legal capacity to contract and use their own means of payment;
• Declares not to make fraudulent use of the Site, contrary to the law or good customs;
• Declares to accept that Portuguese law will regulate any conflict with the consumer, without prejudice to contrary legal provision, community directive, or international treaty.

1.4 - MARSOG, LDA. does not guarantee that all published information complies with the legislation in force in the User's jurisdiction, except for the territory of Portugal and, when applicable, the European Union. Thus, access to content published on the Site from locations where it is illegal is expressly prohibited. Users who choose to access this Site from such locations do so at their own risk and are solely responsible for such act.

1.5 - The User and MARSOG, LDA. agree that any legal issue related to the use of the Site coisasdeviana.pt shall be settled exclusively in the Court of the District of Viana do Castelo, Portugal, without prejudice to imperative provision to the contrary in Portuguese legislation, community directive, or international treaty.

2. PRIVACY

All personal information provided to the Site coisasdeviana.pt will be treated under our Privacy Policy, which you can consult at any time on the Site.

3. SITE CONTENT AND INTELLECTUAL PROPERTY

"Site Content" means all information present therein, including, among others, brands, designs, logos, texts, images, photos, illustrations, audio or video materials, scripts, web design, and software.

The intellectual property rights of all Site contents that are not externally supplied and duly identified as such belong to MARSOG, LDA. and are protected under general law and national and international legislation on intellectual property protection, copyright and related rights, as well as by computer crime law.

This Site also contains texts, illustrations, and photographs that cannot be copied, altered, or distributed without the express authorization of their authors. MARSOG, LDA. rejects any responsibility for the usurpation and misuse of the elements cited above.

4. PERMITTED USE

The User is not permitted to use this Site for other private purposes. The use of any automated system or software to extract data from this Site for commercial purposes (“screen scraping”) is prohibited.

5. SECURITY

Without prejudice to MARSOG, LDA.'s commitment to the confidentiality of personal data and the application of security measures, Users declare they are aware of the limitations of the Internet. MARSOG, LDA. cannot be held responsible for accidental or voluntary damage suffered by Users and caused by third parties within the scope of the use of services provided on this Site (viruses, intrusions, etc.).

6. CONTENTS AND LIABILITY

The information present on this Site was included in good faith. MARSOG, LDA. reserves the right to make changes and corrections, suspend or terminate the Site when it deems appropriate, without prior notice.

MARSOG, LDA. is not responsible for hyperlinks to third-party sites or for the privacy policies of those sites.

7. DISCONTINUATION

MARSOG, LDA. may discontinue the Site at any time without prior notice.

8. ORDER METHODS

8.1 - The User can place their order via the internet, through the Site coisasdeviana.pt (24h/24h) or, in the case of personalized items, by email to encomendas@coisasdeviana.pt.

8.2 - For all orders, the User must be registered and have a valid email account.

8.3 - Ordering any personalized item requires prior email contact for a quote.

ALERT: For personalized orders, it is extremely important to indicate maximum detail (reference, exact measurements, colors, etc.).

8.4 - By placing an order and making the respective payment, a distance Contract is formed between the User and MARSOG, LDA.

9. ORDER CONFIRMATION

9.1 - If there is no payment confirmation, the order will be cancelled.

Warning: Only after payment confirmation will we proceed with the preparation and shipping of the order.

9.3 - In the case of personalized items, order confirmation is subject to an advance payment (deposit) of 50% of the quote value.

Warning: Production of the personalized item only starts after receipt of this deposit.

10. ORDER CANCELLATION

10.1 - If the order has not yet been shipped, contact us immediately to cancel without costs.

10.2 - If it has already been shipped, cancellation is equivalent to exercising the Right of Withdrawal. The User will have to receive the order and return it, bearing the return costs.

10.3 - Personalized Items: If you cancel a personalized order that is already in production, you lose the right to a refund of the deposit paid.

11. REASONS FOR ORDER REFUSAL

MARSOG, LDA. reserves the right to refuse any order, namely in the following situations:

• The information on the invoice is not correct or verifiable;
• The order is flagged by security systems as incorrect, irregular, or suspected of fraud;
• When payment transfer is not received within 5 business days;
• When it is not possible to deliver the order to the provided address;
• If it is verified that there was an error in the price presentation of the item(s).

12. ESSENTIAL CHARACTERISTICS OF ITEMS

12.1 - All traditional and manufactured items are presented with maximum rigor. Photographs are a "presentation suggestion" and the actual item may vary slightly as it is handmade (unique piece).

12.3 - Colors may differ from real ones due to the User's screen.

12.4 - In case of price error, MARSOG, LDA. reserves the right not to process the order (with full refund to the customer).

13. AVAILABILITY

Orders are subject to existing stock or artisan availability (for personalized items).

Attention: If an option (color/size) does not appear in the list, it is because it is sold out.

14. PRICES

14.1 - Prices are in EUROS (€).

14.2 - The price presented ALREADY INCLUDES VAT at the legal rate.

14.3 - Shipping costs are borne by the User and added at the end of the order.

14.6 - The item remains the property of MARSOG, LDA. until full payment of its value.

15. PAYMENTS

IMPORTANT: We do not accept orders with cash on delivery payment.

All methods are secure and encrypted by SSL. We use certified partners: STRIPE, euPago, and PayPal.

CREDIT CARD

Method available for all countries. The debit occurs within a maximum of 4 days.

BANK TRANSFER

Must be made within 5 days to the IBAN indicated in the confirmation email.

MULTIBANCO (Portugal)

You have 48 Hours (2 days) to pay. After this deadline, the order is cancelled.

MB WAY (Portugal)

Simply enter your mobile number and accept in the App.

16. SHIPPING AND DELIVERY

Store Pickup (Free): At the MORDOMA - Artesanato store in Viana do Castelo. Wait for our SMS/Email confirmation before going to the store.

Home Delivery: We ship worldwide (except Brazil). We only ship on business days.

IMPORTANT: In Portugal (CTT Expresso), if delivery fails, it is the User's responsibility to call CTT (21 0471 616) and reschedule. If the order is returned after 2 failed attempts, reshipping will incur new costs for the customer.

16.1 - Shipping Costs:
Portugal: from €7.50 (Free > €200)
Europe/World: Calculated at checkout.

16.2 - Customs Duties:
Outside the EU, customs fees are the Customer's responsibility.

16.3 - Estimated Deadlines (after shipping):
Mainland Portugal: 1-2 business days
Azores/Madeira: 2-5 business days
Europe: 2-7 business days
World: 2-5 business days

17. EXCHANGES AND RETURNS

17.1 - Exchanges: Only for size/color of the same reference, within 14 days. New shipping costs are paid by the User.

17.2 - Returns: Deadline of 14 days from receipt. The item must be in perfect condition.

IMPORTANT: Exchanges or returns of personalized items (made to measure or with User specifications) are not accepted.

17.3 - Instructions:
Access "Order History" in your account, select the order and click on "Returns". Follow the steps. Do not send items via cash on delivery.

17.4 - Costs:
Return expenses are the User's responsibility (unless due to our error).

18. RIGHT OF WITHDRAWAL

18.1 - In the EU, the consumer has the right to cancel the contract within 14 days without justification and be refunded.

18.3 - Exceptions: There is no right of withdrawal for items made according to consumer specifications or personalized.

18.5 - Refund: The refund (including initial shipping costs) will be made within 14 days after communication.

19. ALTERNATIVE DISPUTE RESOLUTION (ADR)

In case of dispute, the consumer may resort to CIAB – Centro de Informação, Mediação e Arbitragem de Conflitos do Consumo (Consumer Arbitration Tribunal).

20. WARRANTY

MARSOG, LDA. assumes the legal guarantee of conformity. Excluded from the warranty are defects caused by:

• Abusive or negligent use (accidents, incorrect washing);
• Normal wear and tear of the item;
• Attempts at fraud.

22. JURISDICTION

These Terms are governed by Portuguese law. The User accepts the jurisdiction of Portuguese courts to settle any conflict.
